We, AliphCom, a California corporation doing business as Jawbone ("Jawbone" or "We") explain in this Privacy Statement what information we receive and collect from and about you, a user of our UP fitness tracking device or other device ("Device"), UP mobile or web application ("UP App"), our mobile sites and websites that you can access with a Device and UP App ("UPsite"), and/or updates to any of the foregoing (collectively "UP Service"). This Statement does not cover any other information that we collect, including, without limitation, data that we collect offline or via our corporate website.
We are headquartered in San Francisco. We host our servers and process information in the United States and other countries. When you use the UP Service, you transmit data to the United States and other countries.
Information We Collect.
Information you actively provide: When you download our UP App, register for an account, connect your Device to your account, use the UP Service or send us requests, we may ask you to provide your first and last name, email address, postal addresses, account name, password, photo, gender, height, weight, and date of birth. You can also choose to upload your address book and Facebook contacts to our servers, or through email address lookup, so we can help you find friends using UP. Other information you may choose to input includes what you eat and drink, your mood, and other activities. We use information on what you eat and drink to provide you with calorie and nutritional information.
Information you automatically provide: When you use or synch your Device, it automatically transmits activity and physical information to us including, but not limited to, detailed physical information based on monitoring your micro movements, including when you are asleep, when you are awake, when you are idle, and your activity intensity and duration. Some Jawbone devices also capture heart rate and other biometric data. This data is translated into information such as your sleep patterns, calories you burn, activities undertaken and your trends and progress. This data can also provide information on certain conditions you may have. Your Device may store up to nine months of data at a time. Your Device and UP App may also transmit precise location data.
When you use other Jawbone apps you connect with and upload to our servers the address book and calendar on your device.
When you use our apps you transfer information about your device, including your device type, manufacturer, model, and operating system; your device ID; and the version of your app. You also transmit information about how you use the app and interact with the pages and features, and a time-stamped log of data exchanges.
Combinations: We may combine information we receive through the UP Service with information we receive about you from other sources, for example, via our websites, requests you may send us, or promotional campaigns.
Use of Information.
Jawbone uses your information to provide and improve our mobile sites, information, products and services; create statistics to promote our services and products; personalize your experience and customize content, marketing, and recommendations; respond to requests that you make, provide you with customer service, general informative announcements, and to send you promotional information about us or our products, or to aid us in serving you better; and protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
Sharing of Information.
We do not rent, sell or otherwise share your individual personal information with third parties, except as follows:
- With your consent, for example to connect with a third party app or service.
- We use affiliated and unaffiliated service providers all over the world that help us deliver our service and run our business subject to confidentiality agreements. For example, we use third party data analytics platforms to help us understand, among other things, server load and app behavior.
- We share aggregated usage statistics that cannot be used to identify you individually, for example through data stories on our blog (www.jawbone.com/blog) or through the media.
- We may share your personal information for the purposes of a business deal (or negotiation of a business deal) involving sale or transfer of all or a part of our business or assets. These deals can include a merger, financing, acquisition, or bankruptcy transaction or proceeding.
Many Device users want to connect with friends and colleagues. When you use your Device, the name you supply and profile image is publicly searchable in the UP directory. We use the email address you register with the UP Service and match it with information other people upload from their address books, Facebook contacts or through email address lookup. If there is a match, we share with that person that you are a Device user and allow them to invite you to connect to be part of their UP team. If you choose to be part of an UP team or add people to your UP team, you choose the UP information you wish to share with your team. Be thoughtful of your own privacy needs as you choose what you share and with whom.
Choices about Your Information.
You can opt-out of promotional emails from us by following the unsubscribe instructions provided in the e-mail you receive, or by contacting us directly (please see contact information below). If you opt-out, we may still send you non-marketing e-mails including e-mails about your accounts and our business dealings with you.
You can choose general types of information you share with friends you add to your UP team by going to Settings>Privacy and Sharing. You can also hide or show individual posts from the posts detail screen. You can delete any activity or sleep tracked in the UP band via the Help screen in the UP app. You can erase band data by going to Settings>Erase Band Data. Performing a hard reset of the band will also erase all data from your band.
In addition, you can request the deletion of your individual user data from our system by visiting https://jawbone.com/user/settings#!accounts and selecting "request data removal" or by emailing email@example.com. You can also request, through the same process, the deletion of your individual user data from any third party apps that may be connected to UP.
You can download your data and export it to a separate CSV file. You can do this by visiting https://jawbone.com/user/settings#!accounts and selecting "download UP data."
Any of your data that has been aggregated into anonymized system usage statistics will remain on our system. It is not possible to extract any individually identifiable information from this data.
Security of Your Information.
We apply organizational and technical measures to ensure access to your information is limited to persons with a need to know. Even though we have taken steps to protect your personal information, you should know that neither we -- nor any company -- can fully eliminate security risks.
Privacy Statement Updates.
We may update this Statement from time to time. When we do, we will change the last updated date above to let you know we made a change.
